浅议如何做好施工合同管理工作 被引量:1

摘要 施工合同管理是工程项目管理的核心,是控制工程造价的重要手段。本文简要阐述了当前建筑市场施工合同管理存在的种种弊端,缺乏健全的合同管理机构;合同条款制定不严密;施工各单位缺乏对施工合同的全面认识;工程实施过程中,合同双方没有严格执行合同条款,导致合同纠纷的产生;没有专门的合同管理人才。这些因素阻碍了工程合同的顺利实施,笔者认为,要解决这些问题必须做好以下工作:合同双方应建立保障合同实施的管理体系,建设行政主管部门应严格执行合同备案制度,加大合同审查力度和合同履约行为监管力度。同时应做好合同后评估工作,通过不断的总结、改进提高合同管理水平,控制好工程造价,实现全生命周期工程造价管理。 Construction contract management is a central part of project management and also an important tool to control project cost.The paper briefly introduces a variety of malpractices in contract management in the current construction market.The terms of construction contracts are usually not formulated strictly with the parties' rights and obligations.Construction organizations are not deeply aware of the meaning of construction contracts.The parties do not execute the contract in strict rotation,which often results in contract disputes.There is a shortage of contract supervision professionals.The author offers some solutions based on personal experience.The parties should fulfill their management duties to ensure the enforcement of the contract.The relevant administration should implement a contract file system,strengthen contract review and completion supervision.Contract fulfillment evaluation is also essential and must include summary and recommendations to improve contract management and control engineering cost to complete the feedback cycle of construction cost management.
