论行政赔补式土地置换的可行性——以H市与F公司土地置换纠纷为中心的分析 预览

摘要 在一级市场里,国有土地的出让应该以招拍挂方式为原则,从而通过公开性和竞争性,实现土地资源的最优配置。但是,当我们把政府储备的国有土地视为一种政府资源时,其在国有土地使用权收回补偿、集体土地征收补偿、地方政府债务的化解甚至行政赔偿案件中,均可视为与政府财政一样的支付对价,即所谓的土地置换。换言之,土地置换是指通过土地用途更新、土地主体转换、土地布局调整、土地产权重组等措施,实现土地现有功能和潜在功能的再开发,从而优化土地资源配置的一种利用模式。该模式盘活了土地资源,增强了土地在纠纷解决时作为对价的物权功能,为社会发展注入了更多的活力。故此,行政赔补式土地置换具有极强的可行性和相当的适法性。 In the primary market,the transfer of state-owned land should be based on the principle of bidding and auction so as to achieve the optimal allocation of land resources through open and competitive mechanisms.However,when the sate-owned land is regarded as a type of resources reserved by the government,it can be accepted as the same payment consideration as the government revenue in the cases involving administrative compensation for the expropriation of the right to use state-owned or collective land,the settlement of local government debt and other administrative compensations.This is what the term“land exchange”means.In other words,land exchange refers to the practice in which the allocation of land resources is optimized through the changes in the purpose of land use,the user of land,the functional adjustment of land,and the ownership of land so as to enhance the current and potential function of land.Such type of up-zoning in China makes it possible to bring the potential of land into full play and strengthen the function of land as a type of consideration in dispute settlement,thus injecting more vitality into social development.Therefore,it is highly feasible and justifiable to use administrative compensation in exchange for land-use right in China.
