Justification and System Arrangement of Virtual Property Rights — Comments on Article No. 127 of General Provisions of the Civil Law 预览

In the process of formulating the General Provisions of the Civil Law of P. R. China, the attribute of virtual property rights has changed from real rights to non-real rights. Article No. 127 thereof does not clarify ... In the process of formulating the General Provisions of the Civil Law of P. R. China, the attribute of virtual property rights has changed from real rights to non-real rights. Article No. 127 thereof does not clarify the nature of virtual property rights after all, and the place where virtual property is put in the “Civil Rights” chapter of General Provisions of the Civil Law makes the concept even more complex and confusing. The “relationships paradigm” protection of virtual property does not have a definite classification criterion, nor stands opposite to the “rights paradigm.” There are two different ways to justify the “theory of virtual property as a real right” under the “rights paradigm” protection, namely, essentialism and consequentialism. The former resulted from utilizing features in a demonstration and identifying disposal rights with real rights, while the latter resulted from adherence to the dichotomy system of property rights comprising real rights and creditor’s rights. From the perspective of larceny in Criminal Law and virtual property insurance in The Social Insurance Law, the attribute of virtual property rights is irrelevant to creditor’s rights. The attribute of virtual property rights shall be defined as virtual property rights so that it can be included in the system of civil rights. The uniqueness of virtual property is enough to become an object of emerging civil rights;intangible property rights as a superordinate theoretical concept cannot reflect the essence of virtual property rights. The legislative frame of virtual property rights shall be comprised of the subject, object, exercise, publication and change of the rights. 展开更多

In Situ Synthesis, Structural Characterization and Catalytic Properties of a 2D Cu(Ⅰ)-cyanide Coordination Polymer 预览

A new Cu(Ⅰ) coordination polymer(CP) formulated as [Cu2(L)(CN)2]n(1, L =1,1′-bis(5,6-dimethylbenzimidazole)methane) was synthesized, in which the cyanide anions were generated in situ by the cleavage of C–C bond of acetonitrile under hydrothermal conditions. CP 1 was characterized by elemental analysis, IR spectroscopy and single-crystal X-ray diffraction. It crystallizes in the orthorhombic system, Pccn space group, with a = 10.314(3), b = 20.966(7), c =9.432(3)?, V = 2039.5(11)?3, Z = 4, C21 H20 Cu2 N6, Mr = 483.51, Dc = 1.575 g×cm^-3,μ= 2.105 mm-1 and F(000)= 984, the final R = 0.0608 and wR = 0.1942 for 1226 observed reflections with Ⅰ> 2s(Ⅰ)for the CP 1. The CP 1 possesses a 2D {63} layer structure which is composed of Cu(Ⅰ) centers bridged by L and CN– ligands. The thermal stability and luminescence properties of CP 1 are discussed in detail. The complex also displays a remarkable activity for the degradation of methyl orange by hydrogen peroxide in a Fenton-like process. 展开更多

Solution treatment is a useful way to improve the degradation resistance of Mg alloys.In this work,effects of solution treatment temperature on mechanical and biodegradable properties of an extruded Mg–2Zn–1Gd–0.5Zr alloy were studied.Microstructure analysis,tensile test, three-point bending test, immersion test and electrochemical test were performed.The results showed that increasing solution temperature decreases the mechanical properties of the alloy.However, three-point bending test revealed that the solution-treated alloy at 510 ℃ could maintain 95% of its maximum bending force(Fmax) during the 28-day immersion period.After treatment at 510 ℃ for 5 h, all the second phases were dissolved into the alloy, the galvanic corrosion was inhibited, and the alloy exhibited good corrosion resistance with a corrosion rate of 0.35 mm·year-1 in Hank’s solution. 展开更多

Poly(vinyl alcohol)/hydroxyapatite(PVA/HA) composite hydrogel was successfully in-situ synthesized via three cycles of freezing-thawing. The composition and structure of products were investigated by X-ray diffraction( XRD), Fourier transformed infrared spectroscopy(FTIR) and scanning electron microscopy(SEM). The influence of different preparation methods and contents of material on the mechanical properties of PVA/HA composite hydrogel was discussed through tensile and compressive tests. The template of PVA could avoid the agglomeration of HA particles, which improves the mechanical properties of the composite hydrogel effectively. The tensile strength, modulus and compressive performances of the PVA/HA composite hydrogel prepared by the in-situ synthesis method were better than those of hydrogel obtained by the simple blend metliod. In addition, the effect of the content of PVA, HA, and the pH value on tlie properties of tlie PVA/HA composite hydrogel has been discussed in detail. 展开更多

刑法上的财物要求具有管理可能性、移转可能性、价值性,一般意义上的网络虚拟财产因具有这三性,可以评价为财物。但是,利用黑客技术非法盗刷的虚拟游戏币,由于在被盗刷之前并不实际存在于任何账户中,无法管理、无从“移转”,且不具有价... 刑法上的财物要求具有管理可能性、移转可能性、价值性,一般意义上的网络虚拟财产因具有这三性,可以评价为财物。但是,利用黑客技术非法盗刷的虚拟游戏币,由于在被盗刷之前并不实际存在于任何账户中,无法管理、无从“移转”,且不具有价值性,不能被认定为财物。以盗窃罪来评价非法盗刷虚拟游戏币行为的做法,既不符合盗窃罪的保护法益和犯罪构成,还极可能造成量刑结果畸重,并不妥当。利用黑客技术非法添加虚拟游戏币的行为对社会管理秩序法益造成了侵害,同时也符合非法获取计算机信息系统数据罪的犯罪构成,因而可以认定为该罪,其定罪标准可以参照《计算机案件解释》的规定予以认定。 展开更多

To examine the effect of pressure on pore structure and petrophysical properties of carbonate rock, the porosity, permeability, CT scanning, SEM and elastic wave velocity of two carbonate core plug samples from an oilfield in Southwest Iran were analyzed under cyclic pressure. One of the plugs was calcite and the other was dolomite with anhydrite nodules. The cyclic pressure exerted on the samples increased from 13.79 MPa to 27.58 MPa in six steps, and the variations in petrophysical properties of the two samples at different pressure loading and unloading steps were counted and analyzed. The results show that the calcite sample decreases in porosity and permeability with the increase of pressure, which is consistent with the results from compression and shear wave velocity tests. In the dolomite sample, the decreasing trend was not observed;fluctuations of compressive and shear velocities were observed during the loading stage, which may be due to different geometries of the pores and the porosity variation in the sample. Understanding the variation of carbonate petrophysical properties with pressure is helpful for optimizing reservoir development scheme. 展开更多

Because of the excellent mechanical properties of 34 CrNiMo6 steel, it is widely used in high-value components. Many conventional approaches to strengthening-steels typically involve the loss of useful ductility.In this study, 34 CrNiMo6 Steel having high strength and ductility is produced by laser solid forming(LSF)with a quenching-tempering(QT) treatment. Tempering of bainite is mainly by solid phase transformation in the previous LSF layers during the LSF process. The stable microstructure of LSF consists of ferrite and fine carbides. The microstructure transfers to tempered sorbite after heat-treatment. The tensile properties of the LSF steel meet those of the wrought standard. The UTS and elongation of LSF sample at 858 MPa, 19.2%, respectively, are greater than those of the wrought. The QT treatment enhanced the ultimate tensile strength and yield strength of the LSF sample. The ultimate tensile strength, yield strength, reduction in area, and elongation of the LSF+QT sample at 980 MPa, 916 MPa, 58.9%, and 13.9%,respectively, are greater than those of the wrought standard. The yield strength of the LSF+QT sample is approximately 1.27 times that of the wrought. The LSF samples failed in a ductile fracture mode, while the LSF+QT samples showed mixed-mode failure. The defects have only a small effect on the tensile properties owing to the excellent ductility of the LSF sample. 展开更多

The oxide dispersion strengthened(ODS) steel with the nominal composition of Fe–14 Cr–2 W–0.3 Ti–0.2 V–0.07 Ta–0.3 Y2O3(wt%) was fabricated by mechanical alloying and hot isostatic pressing(HIP). In order to optimize the relative volume fraction of secondary phases, the as-HIPed ODS steel was annealed at 800°C, 1000°C, 1200°C for 5 h, respectively. The microstructures and different secondary phases of the as-HIPed and annealed ODS samples were identified by scanning electron microscopy(SEM), transmission electron microscopy(TEM), and X-ray diffraction(XRD). The tensile properties of all the ODS steels at room temperature were also investigated. The results indicate that annealing is an effective way to control the microstructure and the integral secondary phases. The annealing process promotes the dissolution of M23C6 particles, thus promoting the precipitation of TiC.No obvious coarsening of Y2Ti2O7 nanoparticles can be observed during annealing. The tensile results indicate that the annealed ODS sample with the optimized secondary phases and high density possesses the best mechanical properties. 展开更多

A flexible urea-functionalized receptor bearing two p-nitrobenzene units was designed and synthesized from the reaction of precursors 4-nitrophenyl isocyanate and 1,2-bis(2?-aminophenoxy) benzene. The receptor was characterized by 1H NMR, MS, FTIR and elemental analysis, and the crystal structure of the receptor was determined by X-ray diffraction analysis. The crystal belongs to the orthorhombic system, space group Pca21 with a = 12.740(2), b =14.133(3), c = 15.842(3)A, V = 2852.4(9) A3, Z = 4, Mr = 620.57, Dc = 1.445 g/cm3, F(000)= 1288,= 0.0585 and wR = 0.1032 for 3177 observed reflections(Ⅰ> 2σ(Ⅰ)), and R = 0.1304 and wR =for all data. The results show that the receptor displays selective recognition ability for H2PO4– in DMSO with a series of anions using UV-Vis absorption spectra technique. The coarse-grained heat-affected zones (CGHAZs) of X100Q steel were reproduced via simulating their welding thermal cycles with the varying heat input (Ef) from 10 to 55 kJ/cm in Gleeble3500 system. The microstructures were characterized, and the impact toughness was estimated from each simulated sample. The results indicate that the microstructure in each simulated CGHAZ was primarily constituted of lath-like bainite. With the decreased heat input and accordingly the lowered Ar3 (the onset temperature for this transition), the prior austenite grain and the bainitic packet/block/lath substructure were refined remarkably, and the impact toughness was enhanced due to the microstructure refinement. The bainitic packet was the microstructural unit most effectively controlling the impact properties in CGHAZ of X100Q steel, due to their close correlation with the 50% fracture appearance transition temperatures, their size equivalent to the cleavage facet and their boundaries impeding the crack propagation. 展开更多
