The Establishment of an Overarching Intellectual Property Judicial System 预览

The intellectual property("IP") judicial system comprises two parts: IP judicial organization and IP judicial mechanism. China’s IP judicial system reform should be carried along with the construction of specialized IP courts, aiming to establish a specialized IP judicial system. Such a system contains five elements. First, the nation-wide specialized IP courts are both courts of first instance and of appeal, which is a mode of "first instance + appeal". Meanwhile, a state-level high court or an IP circuit court of the Supreme People’s Court("the Supreme Court") should be established. Second, IP courts should not be set up everywhere, instead, they should be set up in 10-13 central cities, supplemented with detached tribunals. Third, the judicial mechanism in the IP courts should be "3-in-1", in which civil, administrative and criminal suits are heard by one court. Fourth, the manner of reasoning inherited from administrative authority principles of the civil law system should be avoided, and judicial organs should be given the authority to make substantial judgments on the validity of IP. Finally, in technical cases, a multiidentification mechanism for technical facts should be set up, by establishing systems such as technical investigators, expert consultation, expert juries, and judicial appraisal. Thus, an overarching IP judicial system will be formed, which will separate IP trials from others and strengthen the professional traits of IP trails. Such a judicial system is an optimized choice conforming to the construction of an innovative country and is sufficient for China to present a picture of "strong judicial protection" of IP to the world. 展开更多

Inter-area low frequency oscillation in power system is one of the major problems for bulk power transmission through weak tie lines.Use of wide-area signal is more effective than the local area signal in damping out the inter-area oscillations.Wide area measurement system(WAMS)is convenient to transmit the wide area signal through the communication channel to the remote location.Communication failure is one of the disastrous phenomena in a communication channel.In this paper,a dual input single output(DISO)Hm controller is designed to build the control resiliency by employing two highest observability ranking wide area signals with respect to the critical damping inter-area mode.The proposed controller can provide sufficient damping to the system and also the system remains stabilized if one of the wide-area signals is lost.The time delay is an unwanted phenomenon that degrades the performance of the controllers.The unified Smith predictor approach is used to design a Hm controller to handle the time delay.Kundur's two-area and IEEE-39 bus test systems are considered to verify the effectiveness of the proposed controller.From the simulation results,it is verified that,the proposed controller provides excellent damping performance at normal communication and improves the controller resiliency to counteract the communication failure. 展开更多

Monogamy relation is one of the essential properties of quantum entanglement,which characterizes the distribution of entanglement in a multipartite system.By virtual of the unified-(q,s)entropy,we obtain some novel monogamy and polygamy inequalities in general class of entanglement measures.For the multiqubit system,a class of tighter monogamy relations are established in term of the α-th power of unified-(q,s)entanglement for α≥1.We also obtain a class of tighter polygamy relations in the β-th(0≤β≤1)power of unified-(q,s)entanglement of assistance.Applying these results to specific quantum correlations,e.g.,entanglement of formation,Renyi-q entanglement of assistance,and Tsallis-q entanglement of assistance,we obtain the corresponding monogamy and polygamy relations.Typical examples are presented for illustration.Furthermore,the complementary monogamy and polygamy relations are investigated for the α-th(0≤α≤q 1)andβ-th(β≥1)powers of unified entropy,respectively,and the corresponding monogamy and polygamy inequalities are obtained. 展开更多

However, both ofthem are incommensurate — so far — with plenty of quantum theories of the World. In this contribution, there is outlined a strategyfor unifying the current approaches to the Gravitation. Namely, that the gravitation/gravity should be considered as a consequence ofinteraction — a “pinning effect” — of the Spacetime with the non-integral spin of the Fermions, to saturate/add/ the missing part ofthem. It might induce a deformation/curvature of the Spacetime and known effects on moving material objects, as well aselectromagnetic radiation, including light, and other types of radiation, and properties/parameters of transformations of fields,described in the General Theory of Relativity and another. We develop a unified model, known as MgNet, that simultaneously recovers some convolutional neural networks (CNN) for image classification and multigrid (MG) methods for solving discretized partial differential equations (PDEs). This model is based on close connections that we have observed and uncovered between the CNN and MG methodologies. For example, pooling operation and feature extraction in CNN correspond directly to restriction operation and iterative smoothers in MG, respectively. As the solution space is often the dual of the data space in PDEs, the analogous concept of feature space and data space (which are dual to each other) is introduced in CNN. With such connections and new concept in the unified model, the function of various convolution operations and pooling used in CNN can be better understood. As a result, modified CNN models (with fewer weights and hyperparameters) are developed that exhibit competitive and sometimes better performance in comparison with existing CNN models when applied to both CIFAR-10 and CIFAR-100 data sets. 展开更多

A new unified computational method is proposed for modeling the relationship between the parameters of the high-speed particle-impact texturing process and the final surface morphology of the casting roller. The whole surface-texturing process is divided into three parts. The first part is the acceleration process of particles inside and outside the nozzle,which can be analyzed using the computational fluid dynamics method to obtain the particle impact velocities. The second part is a simulation of the bombardment process of particles onto the roller surface using the LS-DYNA software as the analysis tool and the results obtained in the first part as input parameters. The last part is the continuously random impact process of particles on the casting roller surface to form a functional surface,which is characterized by a simplified roughness model. Finally,the above three parts are combined to establish a unified computational model,the performance of which is successfully verified in a series of experiments. 展开更多

Compressible flows exhibit a diverse set of behaviors,where individual parti-cle transports and their collective dynamics play different roles at different scales.At the same time,the atmosphere is composed of different components that require additional degrees of freedom for representation in computational fluid dynamics.It is challenging to construct an accurate and efficient numerical algorithm to faithfully represent multi-scale flow physics across different regimes.In this paper,a unified gas-kinetic scheme(UGKS)is developed to study non-equilibrium multicomponent gaseous flows.Based on the Boltzmann kinetic equation,an analytical space-time evolving solution is used to con-struct the discretized equations of gas dynamics directly according to cell size and scales of time steps,i.e.,the so-called direct modeling method.With the variation in the ratio of the numerical time step to the local particle collision time(or the cell size to the local particle mean free path),the UGKS automatically recovers all scale-dependent flows over the given domain and provides a continuous spectrum of the gas dynamics.The perfor-mance of the proposed unified scheme is fully validated through numerical experiments.The UGKS can be a valuable tool to study multiscale and multicomponent flow physics. 展开更多

A unified study is presented in this paper for the design and analysis of different finite element methods(FEMs), including conforming and nonconforming FEMs, mixed FEMs, hybrid FEMs, discontinuous Galerkin(DG) methods, hybrid discontinuous Galerkin(HDG) methods and weak Galerkin(WG) methods.Both HDG and WG are shown to admit inf-sup conditions that hold uniformly with respect to both mesh and penalization parameters. In addition, by taking the limit of the stabilization parameters, a WG method is shown to converge to a mixed method whereas an HDG method is shown to converge to a primal method. Furthermore,a special class of DG methods, known as the mixed DG methods, is presented to fill a gap revealed in the unified framework. 展开更多

Forced oscillations(FOs), or low-frequency oscillations(LFOs) caused by periodic, continuous, small power disturbances, threaten the security and stability of power systems.Flexible AC transmission system(FACTS)devices can effectively mitigate LFOs via stability control.We propose a novel method that mitigates FOs by shifting the resonant frequency.Based on the features of the linearized swing equation of a generator, a resonant frequency shift can be achieved by controlling the synchronous torque coefficient using a unified power flow controller(UPFC).Because of the resonance mechanism, the steady-state response of an FO can be effectively mitigated when the resonant frequency changes from the original one, which was close to the disturbance frequency.The principle is that a change in resonant frequency affects the resonance condition.Simulations are conducted in a single-machine infinite-bus(SMIB) system, and the simulation results verify that the method is straightforward to implement and can significantly mitigate FOs.The controller robustness when the resonant frequency is not accurately estimated is also analyzed in the simulations. 展开更多

This paper studies the well-posedness of fully coupled linear forward-backward stochastic differential equations (FBSDEs). The authors introduce two main methods-the method of continuation under monotonicity conditions and the unified approach-to ensure the existence and uniqueness of solutions of fully coupled linear FBSDEs. The authors show that the first method (the method of continuation under monotonicity conditions) can be deduced as a special case of the second method (the unified approach). An example is given to illustrate it in linear FBSDEs case. And then, a linear transformation method in virtue of the non-degeneracy of transformation matrix is introduced for cases that the linear FBSDEs can not be dealt with by the the method of continuation under monotonicity conditions and the unified approach directly. As a powerful supplement to the the method of continuation under monotonicity conditions and the unified approach, linear transformation method overall develops the well-posedness theory of fully coupled linear forward-backward stochastic differential equations which have potential applications in optimal control and partial differential equation theory. 展开更多

The first wave of Chinese immigration was between 1849 to 1882,and 110,000 Chinese immigrants had settled on the west coast of the US,attracted by“Gold Mountain”in California and the large employment of railroad workers(Hsieh).When some anti-immigration acts passed,especially the Chinese Exclusion Act in 1882 which banned Chinese immigration for ten years,only certain documented immigrants were allowed to come to America(Carlin).The Chinese Exclusion Act was not repealed until 1943 when the US needs a smooth relationship with China in World War Ⅱ(Ashabranner).Although the Immigration Act of 1965 continuously had a restrictive impact on Chinese immigrants,productive Chinese immigrants made great contributions to the US economy and politics in a large number of industries and business.One example is building the long railroad which allowed communications between the West and the East,and unified the country after the Civil War.They also brought their cultures to the add to diversity in the United States(Documentary:Silent Chinese laborers in the US).As time went on,more and more Chinese started their new lives in the land which across the Pacific Ocean from their hometowns because of political,economic,and academic factors(Hsieh). 展开更多
